Toolographie LLC

  1. The Marketplace Platform Toolographie LLC is a peer-to-peer tool and equipment rental marketplace. We provide a platform that connects owners of tools and equipment ("Owners") with individuals seeking to rent that equipment ("Renters").

Toolographie LLC is a Facilitator: You acknowledge that Toolographie LLC is not a rental house and is not a party to any agreements entered into between Renters and Owners. We do not own, sell, or provide the equipment listed, nor do we act as an agent or insurer.

  1. Eligibility and Trust Community Standards: Use of this Service is intended solely for persons eighteen (18) years of age or older. Anyone may join, but Toolographie LLC reserves the right to scrutinize reviews, transactions, and listings to maintain community trust.

Vetting: While Toolographie LLC performs initial legwork to verify members, we do not guarantee the conduct of any user or the condition of any tool. Use of the service is at your own risk.

  1. Financial Terms Pricing: Owners have the sole discretion to set rental prices.

Commissions: Toolographie LLC takes a commission on all rental transactions to maintain the marketplace. By using the platform, you agree to pay these fees as part of your transaction.

  1. Late Fees and Returns To ensure the marketplace functions smoothly, equipment must be returned to the Owner by the specified date and time.

Late Return Fees: If a Renter fails to return an item on time, they may be charged a late fee. Unless otherwise specified, the standard late fee is 1.5x the daily rental rate for every 24-hour period the item is overdue.

Administrative Fees: Toolographie LLC reserves the right to charge an additional administrative fee to facilitate the collection of late fees on behalf of the Owner.

Communication: Failure to return an item within 48 hours of the deadline without communication may be treated as theft and reported to the appropriate authorities.

  1. Equipment Condition and Liability "As-Is" Basis: All tools are rented "as-is". Owners are responsible for ensuring equipment is safe and in working order. Renters are responsible for inspecting gear upon pickup.

Damage/Loss: Toolographie LLC is not responsible for tools that are damaged, lost, or stolen during a rental period. We strongly recommend documenting the condition of items via photos before and after each rental.

  1. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOOLOGRAPHIE LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM THE USE OF TOOLS RENTED THROUGH THE PLATFORM, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSS. THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE MARKETPLACE REMAINS SOLELY WITH YOU AND YOUR ABILITY TO LEARN, UNDERSTAND AND PRACTICE SAFE TOOL USAGE BASED ON THE MANUFACTURER'S GUIDELINES.

  2. Termination Toolographie LLC reserves the right, in our sole discretion and without notice or liability, to terminate or suspend any account or access to the Service for any reason, including but not limited to poor peer reviews, late returns, or breach of these Terms.

  3. Governing Law & Dispute Resolution These Terms and your use of the Service are governed by the laws of [Insert State/Country]. Any legal action of any nature shall be brought exclusively in the courts located in [Insert County/City], and you hereby consent to personal jurisdiction in such courts.

Appendix A: Best Practices for Owners Document Condition: Take high-resolution, timestamped photos or videos of your tool immediately before every rental.

Verify Identity: Ask to see a valid government-issued ID that matches the Renter's booking name.

Safety Briefing: Provide a quick walk-through of the tool’s safety features and provide manuals if available.

Appendix B: Renter’s Checklist Inspect Upon Pickup: Check the tool for any existing damage or safety issues before leaving the Owner.

Document Condition: Take your own photos of the tool at the start and end of the rental to protect yourself from damage claims.

Return Clean and On-Time: Avoid late fees by communicating any delays early and returning the tool in the same condition you received it.
